Statement of Consent for Data Privacy
Our company operates internationally. For this reason, it is necessary for our employees to work abroad. Notifications and registrations throughout the EU or international visas and work permits are required for this purpose. The interests and rights of our employees must be safeguarded but it is necessary for us to process various data related to you, in particular personal data within the meaning of Art. 4 no. 1 of the General Data Protection Regulation (GDPR), which are subject to protection under the GDPR and the German Federal Data Protection Act (BDSG-new).
Pursuant to Art. 6 GDPR, the GDPR and the BDSG-new only permit the processing of personal data if such processing is permitted under a law, especially the GDPR and the BDSG-new and the Social Security Code (SGB), or other legal provision or if you, the employee (hereinafter only referred to as “Employee“, “You“ or “I“), gave us your consent to process your personal data.
With the consent below you declare that you agree to the processing of your personal data to the extent shown in the consent. Any other processing of your personal data by us that is not permitted by this consent, a law or other legal provisions, is expressly prohibited.
1. Personal data
1.1 Your following master data is covered by this consent:
- Last name, birth name if applicable, first name(s), title
1.2 The following data concerning the economic and contractual situation with the employer is covered by this consent:
- Start date of the employment relationship and (if applicable) the agreed end date
- Wage category according to employment contract
- Agreed gross salary and due date, minus any earnings in kind such as meals, lodging, heating and lighting
- Fixed pay for overtime if applicable
- Duration of the termination period and termination dates
- Regular work site
- Vacation days
- Agreed working hours
- Hours worked
- Applicable employment contract
- Applicable company agreements
- Name and address of company pension fund
- If applicable, additional data depending on target country and category of registration/visa processing
2. Employee’s consent to the transfer to third parties
2.1 I consent that my employer may transfer the data shown in item 1 to the following persons and institutions for the purposes mentioned in each case (Art. 4 No. 2 GDPR):
- to the visa and immigration provider – Inhouse Mobility GmbH
- to the consulates and foreign representative offices, as well as government offices in the relevant target countries
2.2 Data as shown in item 1 will only be disclosed to third parties other than those mentioned in item 2 to the extent permitted by law or required to fulfill a legal obligation owed by us.
3. Duties of the employer in connection with processing personal data
3.1 The employer will only process my personal data according to the statutory provisions. I may request information as per Art. 13 GDPR regarding the type and extent of the processing of my personal data from the employer at any time.
3.2 At my request, the employer will provide information about the processing of my personal data pursuant to Art. 15 GDPR at any time. My rights under the GDPR as well as the BDSG-new, especially my right to rectification, erasure and blocking of data are not affected by this consent.
4. Revocation of consent
4.1 I am aware that revoking my consent does not affect my employment relationship in any way.
4.2 I am aware that I can fully or partially revoke my consent with effect for the future at any time. Revoking my consent does not affect the legitimacy of the processing carried out until revocation of the consent.
4.3 I am aware that revoking my consent does not affect my employer’s right to process my personal data to the extent permitted by Art. 6, 85 ff. GDPR, especially according to Art. 88 GDPR in connection with § 26 BDSG-new.
